In a significant development, the case against former President Donald Trump and his co-defendants has taken a new turn, with allegations of a conspiracy to overturn the 2020 presidential election results in Georgia.
The responsibility of overseeing this case falls on Judge Scott McAfee, a lifelong Georgian, who assumed his role as a Fulton County Superior Court judge in February. His extensive career encompasses roles as a prosecutor and state inspector general, where he spearheaded investigations into fraud, waste, and abuse within the state government’s Executive Branch.
McAfee’s appointment as inspector general in March 2021 was met with praise from Georgia Governor Brian Kemp, a Republican, who commended his robust prosecutorial background. Kemp lauded McAfee’s ability to identify and bring to justice those who flout the law, citing his experience as a tough prosecutor in various capacities.

Before assuming the role of inspector general, McAfee held key positions as an assistant United States attorney in the Northern District of Georgia and a senior assistant district attorney in the Fulton County Atlanta Judicial Circuit. In these roles, he successfully prosecuted cases spanning drug trafficking, fraud, armed robbery, and murder.
The academic journey of Judge McAfee reveals his diverse interests, having acquired an undergraduate degree in music from Emory University, where he was a recipient of a cello scholarship and actively participated in the university orchestra. Subsequently, he earned his JD from the University of Georgia School of Law.
Raised in Kennesaw, Georgia, McAfee is a family man, married with two children. Alongside his accomplished legal career, he engages in volunteer scuba diving and captains a tennis team.
The indictment, unveiled late Monday night, contains 13 charges against Trump, including a racketeering allegation centered on his purported attempt to unlawfully manipulate the 2020 election outcome in Georgia. Notably, Trump is among 19 individuals indicted in this case, and he has consistently refuted any allegations of misconduct.
